Terms of Service

These Terms of Service ("Terms") are a legal agreement between you and NexaServe ("NexaServe", "we", "us", "our"), governing your access to and use of NexaServe's website, dashboard, and the digital tools and automation modules made available through it (together, the "Service"). By creating an account, signing in, or otherwise using the Service, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. Eligibility

You must be at least 18 years old to use the Service. By using the Service, you confirm that you meet this requirement and that you have the legal capacity to enter into this agreement. The Service is not directed at, and must not be used by, anyone under 18.

2. Your account

  • Access to the Service requires signing in with, and maintaining membership of, our Discord community. Losing that membership, or being removed or banned from our Discord server, may result in loss of access to the Service.
  • You are responsible for keeping your account, login, and any linked third-party accounts (Discord, Google, or otherwise) secure. You are responsible for all activity that happens under your account.
  • One account per person. Creating multiple accounts to evade a ban, a cooldown, a paywall, or any other restriction is a violation of these Terms.
  • We may require additional verification (including identity or payment verification) before granting or continuing access, at our discretion.

3. The Service

NexaServe provides a range of digital tools and automation modules, some free and some available only with a paid subscription. Exactly which modules exist, what they do, and whether they are free or paid may change over time without notice, at our discretion.

Some modules interact with, generate accounts on, retrieve information from, or take actions on third-party platforms and services that are not owned, operated, or controlled by NexaServe (for example — without this being an exhaustive or fixed list — ride-hailing, train-booking, food-delivery, retail, telecoms, and email platforms). We refer to these as "Third-Party Platforms" throughout these Terms.

4. Third-party platforms — please read this section carefully

  • No affiliation. NexaServe is an independent service. We are not affiliated with, endorsed by, sponsored by, or officially connected to any Third-Party Platform or brand referenced on or accessible through the Service. All trademarks, logos, and brand names belong to their respective owners.
  • You use Third-Party Platforms at your own risk and under their own terms. Any account created, action taken, code redeemed, or transaction made on a Third-Party Platform through the Service is subject to that platform's own terms of service, privacy policy, and acceptable-use rules — not ours. It is your responsibility to ensure your own use complies with those rules.
  • No guaranteed outcome. We do not control, and cannot guarantee, the availability, pricing, validity, or continued honouring of any promotion, discount, stock item, booking, or account on a Third-Party Platform. Third-Party Platforms may change, withdraw, reject, cancel, or suspend any of these at any time, for any reason, entirely outside our control.
  • No liability for third-party action. We are not responsible or liable for any suspension, ban, restriction, chargeback, loss, or other action taken by a Third-Party Platform against you or an account associated with you, however it arises.

5. Purchases, access & refunds

  • One-time purchase, not a recurring subscription. Paid access is a single, one-off payment through our payment processor (Stripe) that grants you access to the Service for the fixed number of days shown at checkout. There is no recurring billing and nothing auto-renews — once that access period ends, you simply no longer have access unless you purchase again. There is nothing to "cancel" because nothing bills again.
  • Access begins immediately once your payment is confirmed.
  • All sales are final. Except where required by applicable law, we do not offer refunds, in full or in part, for any reason — including if you stop using the Service, are suspended for breaching these Terms, or simply change your mind, before your access period ends.
  • Your 14-day withdrawal right does not apply to this purchase. UK consumer law (the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013) normally gives you 14 days to withdraw from an online purchase. That right does not apply here: because you are buying digital content/a digital service that we begin supplying to you immediately on payment, completing a purchase is your express request that we start providing access straight away, and your acknowledgment that doing so means you lose the right to withdraw once we've begun. If you don't want to lose that right, don't complete the purchase.
  • Discount and promotional codes are single-use, non-transferable, and may be withdrawn or invalidated at any time.
  • Prices are shown in GBP unless stated otherwise and may change at any time; a price change never affects a purchase you've already made.

6. Payment cards used for a third-party transaction

Certain modules complete a real transaction on a Third-Party Platform on your behalf — for example, booking a ride or a ticket. Where that's the case:

  • You provide your own payment card for the sole purpose of completing that specific transaction on the Third-Party Platform, using your own funds. We do not add any separate charge of our own on top of that.
  • Your card details are transmitted securely and are stored, if at all, only in encrypted form, solely so you can view your own transaction history, continue an in-progress transaction, or so we can help you troubleshoot a problem you report. We do not sell your card data, and we do not share it with anyone except as strictly necessary to complete the transaction you asked for.
  • You are solely responsible for making sure any card you provide is your own, valid, and that you're authorised to use it. Providing someone else's card without their permission is fraud, will result in immediate termination of your account, and may be reported to the relevant authorities.
  • We do not control whether a Third-Party Platform accepts, declines, holds, or flags a given card or transaction — see Section 4.

7. Acceptable use

You agree not to:

  • use the Service for any unlawful purpose, or to commit fraud against NexaServe, a Third-Party Platform, or any other person;
  • resell, share, sublicense, or provide access to your account or subscription to anyone else;
  • attempt to reverse-engineer, decompile, scrape beyond normal intended use, or interfere with the operation, security, or anti-abuse measures of the Service;
  • use the Service to harass, defraud, or cause harm to any other person or organisation;
  • attempt to circumvent a ban, suspension, cooldown, rate limit, or paywall, including by creating additional accounts, devices, or identities;
  • initiate a chargeback or payment dispute without first contacting us to resolve the issue in good faith.

We may investigate suspected violations and take any action we consider appropriate, including warning, suspending, or permanently banning an account, and, where fraud or a chargeback is involved, banning associated accounts, devices, or payment methods.

8. Intellectual property

The Service itself — its design, code, branding, and original content — belongs to NexaServe or its licensors and is protected by applicable intellectual property laws. These Terms don't grant you any right to use our branding except as needed to use the Service normally. Third-party names, logos, and trademarks referenced on the Service remain the property of their respective owners and are used only to describe what a module does.

9. Service availability & disclaimer of warranties

The Service is provided "as is" and "as available", without warranties of any kind, whether express or implied, including — to the fullest extent permitted by law — any implied warranty of satisfactory quality, fitness for a particular purpose, or non-infringement. We do not warrant that the Service will be uninterrupted, error-free, secure, or that any specific module, feature, or third-party integration will remain available or continue to function as it does today.

10. Limitation of liability

To the fullest extent permitted by law, NexaServe will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising from or related to your use of the Service. Our total liability to you for any claim arising out of or relating to these Terms or the Service is limited to the amount you actually paid us in the 3 months immediately before the event giving rise to the claim. Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited, such as liability for death or personal injury caused by our negligence, or for fraud.

11. Indemnity

You agree to indemnify and hold NexaServe harmless from any claim, loss, liability, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Service, or your violation of a Third-Party Platform's own terms.

12. Suspension & termination

We may suspend or terminate your access to the Service at any time, with or without notice, for a breach of these Terms, suspected fraud or abuse, a chargeback, or at our reasonable discretion. You may stop using the Service, and delete your account, at any time. Sections of these Terms that by their nature should survive termination (including Sections 4, 6, 9, 10, 11, and 15) will continue to apply.

13. Privacy

Our handling of your personal data — what we collect, why, how long we keep it, and your rights over it — is described in our Privacy Policy. By using the Service you also agree to that policy.

14. Changes to these Terms

We may update these Terms from time to time. If we make a material change, we'll take reasonable steps to let you know (for example, an in-app notice or a message in our Discord). Continuing to use the Service after a change takes effect means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of England and Wales, without regard to conflict-of-law principles. Any dispute arising out of or relating to these Terms or the Service will be subject to the exclusive jurisdiction of the courts of England and Wales, save that nothing here removes any protection you're entitled to as a consumer under the mandatory laws of the country you live in.
